We must follow all State and Federal Laws and will not deviate from them. If an item is not considered inaccurate, misleading, obsolete, duplicate or unverifiable, then we will not dispute the item on your credit report. For any efforts to be effective, you (the client) must be truthful and diligent in giving the correct information to MCA reserves the right to cancel the agreement with any client it believes to be providing false or fraudulent information to us, its creditors or the credit bureaus. If necessary, you can cancel our services at any time in writing. Guarantee – By federal law we cannot guarantee a particular score or result on your credit file. Because we have years of experience helping our clients utilize and exercise their rights under federal law, the Fair Credit Reporting Act, we can assist you in getting information corrected or deleted with an overall positive outcome in the majority of our client’s cases. Also we cannot guarantee that your credit score will increase, or decrease. There are many factors that determine your credit scores. This is a service based business, not a product based business where you can take the product back if it is defective. You are paying for the above mentioned services and our expertise, not a particular result. For an example, if you gave a retainer fee to an attorney to represent you, they would not be able to guarantee to win your case. Negotiating debt – We can provide debt settlement services for you if you have existing or old debts to pay. This is a legal and viable option instead of filing bankruptcy. In most cases our clients will save approximately 70% of their overall debt. Client(s) Responsibilities MCA is here to help you to make the credit restoration process as easy as possible. It is imperative that in order for you to achieve the best results from your credit restoration process, you agree to follow the steps outlined below and you confirm that: You have received a copy of the Consumer Credit File Rights, Notice of Cancellation, and Credit Consulting Agreement. You will respond to our request for additional information or identification documents within a timely manner (within 10 days). You will check and open all incoming postal mail during the credit restoration process. In approximately 5-6 weeks you will receive your updated credit reports with results from all three credit bureaus. They come in business sized envelopes & look like ‘junk mail’. You will forward all updated credit reports and results you receive from all three credit bureaus (Experian, Trans Union and Equifax) to MCA OR... you will need to get your credit reports for $1 from a credit monitoring service. The link will be provided when onboarding to our client site. You understand that your credit scores may lower if any of the following occurs: new negative accounts appear on your credit reports; you apply for new credit; you obtain a new credit card or loan; a corrected or deleted account reappears; or your balances increase on an existing account(s) or you close too many accounts or other various factors beyond our control. You agree to not apply for new credit while in the credit restoration process unless instructed to do so by MCA in which would only be to establish new credit to raise your credit scores because you have very little credit or no credit. If advised by MCA to establish new credit, you agree to implement the necessary steps within 15 days of your first consultation. You understand that if you are obtaining a loan, there are several factors in getting approved for a loan, they can be: down payment, debt to income ratio, time on the job, proof of income, and of course credit issues or low credit scores or other various factors beyond our control. You agree to notify us within 60 days if you have not received your updated credit report results from the three credit bureaus. If you notify us after 60 days from beginning the restoration process, there will be a charge of $50 per person for processing the delayed paperwork. We need your updated credit reports in order to review the results we have obtained for you to see if we need to continue the credit restoration process. You understand that once you begin the Credit Repair process, in about 40 days, we will either need you to provide us all 3 credit reports the credit monitoring service or you can send us all three (3) updated credit reports that you received in the mail from each of the three credit bureaus - Experian, Trans Union and Equifax so we can process your results. You will have patience during the credit restoration process. Sometimes this process takes time and is not a quick fix. Although we have had great results within 30+ days, the process may take longer depending on various circumstances and the number of accounts that we are disputing. Please know that your failure to follow these procedures could result in a delay in achieving your credit restoration goals. MCA will not refund fees if the credit restoration process is delayed or fails because of your failure to cooperate. You may also be required to pay additional fees if additional consultation or preparation of documents is necessary.
